If you come to us as a surfer or bodyboarder, we not only want to offer you great surf or bodyboard sessions, but also make your day with us an all-round experience from which you can also take photos or videos of your rides home with you. We therefore ask you to give your consent below to the creation, processing, storage, presentation and making available to the public of photos and film recordings by us.

You hereby give Surftown GmbH your consent to take photos and videos of you while surfing or bodyboarding as part of a surf or bodyboard session and to process them for the purpose of assigning and compiling recording sequences of your rides and to store them on a platform (“Platform”) that is only publicly accessible to a limited extent. We have the entire surf or bodyboard session photographed by a photographer and filmed by a video system installed at the wave pool. All surfers and bodyboarders are photographed or recorded on video and then the respective images and videos are individually assigned to you and the other participants in your surf or bodyboard session with the help of the software-based evaluation of the participants' physical characteristics. In this way, with the support of artificial intelligence, photo and video files from your rides in the respective surf or bodyboard session are created by the third party engaged by us, Flowstate Zone Pty Ltd. Such files only contain recordings of you ("Session Film") and are stored for a period of 30 days on Flowstate Zone’s platform that is only publicly accessible to a limited extent ("Platform")..

Following your surf or bodyboard session, we will show clips from the surf or bodyboard session and possibly the Session Film on monitors or similar devices in the surf park. You will also receive an email with an internet link to the Platform, where you can access the Session Film after registering with Flowstate Zone, watch it with your child and then decide to purchase it. Via a corresponding link, all other participants in your child's surf or bodyboard session also have access to all files stored on the Platform for this surf or bodyboard session and could therefore also access the Session Film intended for your child. We will ask all participants to view and purchase only the surf or bodyboard session film that contains the footage of the respective participant. However, we cannot guarantee that all participants will adhere to these guidelines. However, please be assured that neither your nor your child's name or any other personal data of you or your child will be published by us, not even as source text to the photos and/or videos. We will not publish the photos or videos of your child's rides or their Session Film in print media, on websites, in social media or other publications, nor will we use them for advertising or marketing purposes. The Session Film with the recordings of your child will be automatically deleted after the storage period of 30 days has expired.

You hereby also consent to the screening of your Session Film on monitors or similar devices in the surf park and to making your Session Film available to the public on the Platform for the purpose of viewing and purchasing the recordings of your surf or bodyboard session, whereby both access to your Session Film and its purchase would also be possible for other participants in your surf or bodyboard session. If you do not agree to the storage and making available of your Session Film to the public on the Platform and are therefore not interested in viewing and possibly purchasing your rides after completing your surf or bodyboard session, you have the option of requesting the deletion of your Session Film from a member of our team at the cash desk before leaving the surf park, which will then be arranged immediately.
